dat.form Terms of Use

1. Application of these Terms
These Terms govern the use of the dat.form mobile application (the App). The App is provided by Datspire, a sole trader business operating in Queensland, Australia (Datspire, we, us or our).
2. Licence and permitted use
Subject to these Terms, you may use the App for your personal, non-commercial wellness records.
You must not:
- misuse the App or interfere with its operation;
- bypass or attempt to bypass a security control; or
- use the App in a way that infringes another person's rights or contravenes applicable law.
3. Your responsibilities
You are responsible for:
- the accuracy of information you enter;
- securing your device and access to the App;
- deciding whether and with whom to share information; and
- retaining any separately shared records you wish to keep.
4. Recommended audience
The recommended audience is people aged 16 and over. This is not a mandatory eligibility condition, and the current App does not verify age.
5. General-wellness information
The App provides personal records, estimates, trends and general-wellness information. It does not diagnose, treat or provide professional healthcare advice and does not replace advice from a qualified health professional.
Results may be incomplete, approximate or unsuitable for your circumstances. You must not use the App for emergencies or as the sole basis for decisions concerning medical care, nutrition, exercise, medication, mental health or an eating disorder. Read the Health Information Disclaimer before relying on a result.
6. Local records and sharing
The current App stores records locally on your device. It does not create a Datspire account or store a server copy. Records may be lost through device loss, deletion within the App, use of Erase app data, or storage failure. Making your own backup is the way to guard against that loss, and whether to make one is your decision.
The App provides a manual backup, export and restore feature that you operate yourself. The exported archive is encrypted with a passphrase you choose, and Datspire neither holds that passphrase nor can recover it or open the archive. You hand the exported file to your operating system share sheet and choose its destination; Datspire does not receive it. Restoring an archive replaces the record on your device once you confirm, and a backup you have already saved is not removed by deleting data in the App.
If you separately share content using a feature available in the App, you choose the receiving application, service or person. Datspire does not control the recipient or copies retained outside the App.
7. Payments and advertising
The App on Google Play is free to download and shows advertisements. The advertisements are supplied by Google AdMob, a third party. Datspire does not choose individual advertisements or endorse what they offer.
Remove ads is an optional one-time purchase made through Google Play. It removes the advertisements from the App. It is not a subscription and does not renew. While Google Play shows the payment as pending, the advertisements stay.
The price is the one Google Play shows before you confirm the purchase, and Google Play takes the payment.
Remove ads is tied to the Google Play account that bought it. It is active on any device using that Google Play account, and the App finds it again after a reinstall or on a new device. You can also use Restore in More > Purchases. It does not transfer to another Google Play account or to another app store.
The App checks the purchase with Google Play. Until Google Play has answered after the App opens, the App shows no advertisements. If Google Play has answered that you have not bought Remove ads, and a later check while the App is still open cannot reach Google Play, the App keeps that answer and can still show advertisements. If Google Play refunds the purchase or no longer shows it on your Google Play account, the App shows advertisements again.
To ask for a refund, contact Google Play, or contact Datspire at support@datspire.com or from Help & support in the App. Google Play may refund some purchases under its own policies.
We do not refund a change of mind. This does not limit your rights under the Australian Consumer Law. If Remove ads does not work as described, contact us. For example, advertisements still appear while the purchase is active on your Google Play account. You are entitled to a remedy, and for a major failure that can be a refund.
If a future version offers another purchase, a subscription or a purchase through another store, the applicable price, billing terms, restoration arrangements and disclosures will be provided before that feature is enabled.
8. Intellectual property
Except for information you enter and third-party materials, the App and its original content are owned by or licensed to Datspire and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of that intellectual property to you.
Open-source components remain subject to their applicable licences. Release-specific components and licence terms are identified in the Open Source Notices for that release.
9. Availability and changes to the App
Datspire may maintain, correct, modify or discontinue App features, subject to applicable law. Datspire does not promise uninterrupted availability or that every estimate will be free from error.
10. Consumer rights
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified, including any applicable right under the Australian Consumer Law.
11. Changes to these Terms
Datspire may amend these Terms to reflect changes to the App or applicable requirements. Each published version will state its effective date. Material changes will be notified through an appropriate channel and will not take effect before the stated effective date.
